Brief: Dental association says lawsuit is abuse of system

AUSTIN (AP) - A lawsuit that claims mercury-based fillings placed in the teeth of a pregnant woman caused severe autism in her son is an "abuse of the legal system," the Texas Dental Association said Thursday.

California lawyer Shawn Khorrami is suing Lufkin dentist Taylor McKewen, the Texas and American dental associations and more than 30 corporations involved in manufacturing the fillings.

The Texas lawsuit was filed last week. It seeks unspecified millions of dollars, alleging that the fillings caused severe autism in Cody Wyatt Botter, a 4-year-old Alabama boy born in Texas.

"It is durable, easy to use, and relatively inexpensive in comparison to other materials and therefore remains a valued treatment option for dentists in consultation with their patients," TDA President Don Lutes wrote in a letter.

Khorrami's lawsuit "is an unfortunate abuse of the legal system. Actions like this, and the dozens of similar lawsuits filed by Mr. Khorrami in other states, use information without scientific basis to exploit vulnerable people and mislead the public," Lutes wrote.
