Autistic Children Face Lawsuit Limits

A Measure Slipped In The Homeland security bill would mean those injured by childhood vaccines could collect only $250,000.

If the long-awaited homeland security bill passes Congress next week as expected, it could mean a big setback for parents of autistic children like 4-year-old Nicholas Liu.

Kevin and Mache Liu are among the parents of some 150 autistic children who have filed suit against the drug industry in the past two years, alleging their children's conditions were caused by Thimerosal, a mercury preservative once included in childhood vaccines designed to prevent measles, mumps and rubella.

Although the bill is intended to create a federal Homeland Security Department, it includes a little-known, last-minute amendment that will effectively end legal battles for compensation from several major drug manufacturers.

The amendment would keep the lawsuits out of state courts, preventing huge judgments, and instead send complaints to a 14-year-old federal program limiting compensation for children who suffer side effects of vaccines to $250,000.

The amendment is one of more than a half-dozen tacked onto the bill. The homeland security bill has been agreed to by House and Senate leaders, but it is not expected to come to a final vote in the Senate until shortly before Congress adjourns next week.

Some Senate Democrats want to challenge the amendments, but that would be difficult because the House went home for the year after passing the bill. House members would have to be called back to Washington to approve the amended bill and get it to President Bush. House leaders have said they don't want to call representatives back.

"Does this have anything at all to do with homeland security? The answer is no," Sen. Byron Dorgan, D-N.D., told the Associated Press. "This is bad legislation."

As usual, nobody in Congress is taking direct responsibility for adding the drugmaker amendment, which will save the pharmaceutical industry millions, if not billions, of dollars.

Rep. Dick Armey, R-Texas, has denied reports that he wrote the amendment at the urging of White House officials. Armey's spokesman said it came from Sen. Bill Frist, R-Tenn. Frist's aides said that while he wrote a similar provision that never passed, he had nothing to do with putting it into the homeland security bill.

Executives of Eli Lilly & Co., a leading defendant in the parents' lawsuits, say they are pleased with the amendment but have no idea how it wound up being attached to the homeland security bill.

The pharmaceutical industry contributed more than $14-million to congressional candidates before the Nov. 5 election, more than three-quarters of it to Republicans. Lilly alone contributed $1.6-million, making it the most generous political donor in the industry. Democrats, meanwhile, were heavily backed by trial lawyers in this year's elections.

Attorneys for the autistic children were stunned to learn of the amendment.

"Holy smokes!" declared Jack Marstall, a lawyer in Louisiana.

"I guess my 4-year-old client represents a threat to homeland security," added Charles S. Siegel of Dallas.

"The industry has seized the opportunity presented by a Republican House and Senate to immediately pass legislation to get the industry off the hook," Dallas lawyer Andrew Waters told the Washington Post. "To me, it looks like payback for the fact that the industry spent millions bankrolling Republican campaigns."

Siegel's clients, the Liu family, are seeking compensation from the drug companies for medical and educational expenses, as well as for pain and suffering, on grounds the industry failed to warn parents of the potential danger of Thimerosal. No compensation figure is specified in their suit.

According to Siegel, Lilly executives told top White House officials recently that their company would not participate in the administration's program to produce smallpox vaccine unless it got immunity from suits filed by those who suffer from side effects of the vaccine.

Lilly spokesman Edward Sagbiel said the allegation was "absolutely false." He said the purpose of the amendment was to "stem the tide of frivolous lawsuits" filed by plaintiffs' lawyers against pharmaceutical and other industries.

Sidney Taurel, Lilly's chairman, president and chief executive, is a member of the White House Advisory Council on Homeland Security.

By executive order after Sept. 11, 2001, President Bush declared that makers of smallpox vaccine will be protected from any liability by the government if they are sued in the future for adverse reactions among patients. The administration has already indemnified Wyeth and Aventis Pasteur on that basis, and a third company is awaiting approval.

Both Sagbiel and Richard Diamond, spokesman for Armey, said the legislation was simply designed to clarify the intent of the 14-year-old National Childhood Vaccine Injury Act.

Lilly has not manufactured Thimerosal for 20 years, Sagbiel said, and the industry now relies on a different preservative in MMR vaccine. Medical research has not established a link between autism and Thimerosal.

Siegel said he does not understand why the drug industry needs help from Congress if their legal case is already so strong. "To say this is not an Eli Lilly bailout is ridiculous," he added.

Nicholas Liu of Pflugerville, Texas, was developing normally until he turned 16 months old, Siegel said. "Then he completely changed, as his parents say, retreating into his own world."

He said the parents are convinced the change was linked to the vaccine he received from his physician.

Shields for Vaccine Makers Weighed

Bush administration already offers it in war on terrorism

While senators debate shielding childhood vaccine makers from lawsuits, the Bush administration already has provided such protection for at least two vaccines key to the war on terrorism — smallpox and anthrax.

With Little Fanfare, President Bush used an executive order to immunize smallpox vaccine makers from lawsuits, officials say. Under an order he issued after last year’s Sept. 11 terrorist attacks, the Department of Health and Human Services can take on liability for companies it contracts with to fight terrorism.

So far, the department has indemnified two companies providing smallpox vaccine — Wyeth and Aventis Pasteur — and is working on an arrangement with a third contractor, Acambis Baxter, agency spokesman Bill Pierce said Friday. That means that if someone sues for negligence over the vaccine, the department assumes liability rather than the manufacturer.

“We have asked them to do this for us for a program that we are running and managing,” Pierce said. “So, therefore, instead of them holding the risk, we’re holding the risk, since we are the ones driving this.”

The smallpox vaccine hasn’t been administered in the United States in years, and the companies are back in the business of providing it only because the government asked, Pierce said. The department isn’t taking on liability for the maker of Cipro or other anthrax treatments because those products were already in the marketplace, he said.

Other government agencies involved in national defense have long had the power to indemnify contractors; the Department of Defense, for example, has granted indemnity to Bioport, the maker of an anthrax vaccine. Bush’s executive order added the health department to the law allowing it.

Protecting Vaccine Makers

While that drew little attention, a move this week to reduce liability for vaccine makers — whether their shots are used to fight terrorism or not — by the GOP-controlled House in legislation creating a Homeland Security Department has brought strong opposition from several Senate Democrats.

They promised Friday to try to take that provision out of the bill, and accused Republicans of providing a last-minute reward to the pharmaceutical industry, a major GOP political donor.

“Does this have anything at all to do with homeland security? The answer is no,” said Sen. Byron Dorgan, D-N.D. “This is bad legislation.”

They drew support from at least one Republican, Rep. Dan Burton of Indiana, chairman of the House Government Reform Committee. Burton was unaware of the provision when he voted for the measure Wednesday and wants it removed, spokesman Blain Rethmeier said.

“Instead of passing legislation to take away the rights of families with vaccine-injured children, we should be passing legislation to try to help them,” Burton said Friday in a written statement.

The Association of Trial Lawyers of America, a major Democratic donor, also was lobbying to have the provision removed.

Autism Lawsuits

ATLA spokesman Carlton Carl said it would directly affect parents who believe a child’s autism was caused by Thimerosal, a mercury-containing ingredient that used to be a component of several childhood vaccines, Carl said.

The provision would require those who wish to sue former makers of Thimerosal such as Eli Lilly to instead pursue their claims through a federal vaccine compensation program that caps damages at $250,000, Carl said. Medical research has not established a link between autism and Thimerosal, but many parents believe the ingredient may be to blame and are suing manufacturers.

Burton On Homeland Security Provision Prohibiting Vaccine-Injury Lawsuits

Washington, D.C. - Congressman Dan Burton (R-IN), Chairman of the Committee on Government Reform, made the following statement Friday regarding provisions in the Homeland Security bill prohibiting vaccine-injury lawsuits:

"These provisions don't belong in this bill. This is not a homeland security issue. This is a fairness issue. 15 years ago, one in every 10,000 children was autistic. Today, one in every 250 children is autistic. We have an epidemic on our hands. More and more parents believe that the autism affecting their children is related to a vaccine, or a mercury preservative used in numerous vaccines given to their children. These provisions in the Homeland Security bill will cut off their recourse to the courts, and that's just wrong."

"Instead of passing legislation to take away the rights of families with vaccine-injured children, we should be passing legislation to try to help them. We also need to fund the research that will help us understand the effects of the mercury preservatives used in vaccines."

Sections 1714 to 1717 of the Homeland Security Act of 2002 would prohibit lawsuits - including all pending litigation - by families of injured children alleging that a component, ingredient, adulterant or contaminant of a vaccine caused the injury. These provisions, which were not in the original bill, were approved by the House on Wednesday, and are being debated in the Senate today.

If the Homeland Security Act is not amended before passage, here is what will happen to you:

Every purchase you make with a credit card, every magazine subscription you buy and medical prescription you fill, every Web site you visit and e-mail you send or receive, every academic grade you receive, every bank deposit you make, every trip you book and every event you attend - all these transactions and communications will go into what the Defense Department describes as "a virtual, centralized grand database."

To this computerized dossier on your private life from commercial sources, add every piece of information that government has about you - passport application, driver's license and bridge toll records, judicial and divorce records, complaints from nosy neighbors to the F.B.I., your lifetime paper trail plus the latest hidden camera surveillance - and you have the supersnoop's dream: a "Total Information Awareness" about every U.S. citizen.

This is not some far-out Orwellian scenario. It is what will happen to your personal freedom in the next few weeks if John Poindexter gets the unprecedented power he seeks.

Remember Poindexter? Brilliant man, first in his class at the Naval Academy, later earned a doctorate in physics, rose to national security adviser under President Ronald Reagan. He had this brilliant idea of secretly selling missiles to Iran to pay ransom for hostages, and with the illicit proceeds to illegally support contras in Nicaragua.

A jury convicted Poindexter in 1990 on five felony counts of misleading Congress and making false statements, but an appeals court overturned the verdict because Congress had given him immunity for his testimony. He famously asserted, "The buck stops here," arguing that the White House staff, and not the president, was responsible for fateful decisions that might prove embarrassing.

This ring-knocking master of deceit is back again with a plan even more scandalous than Iran-contra. He heads the "Information Awareness Office" in the otherwise excellent Defense Advanced Research Projects Agency, which spawned the Internet and stealth aircraft technology. Poindexter is now realizing his 20-year dream: getting the "data-mining" power to snoop on every public and private act of every American.

Even the hastily passed U.S.A. Patriot Act, which widened the scope of the Foreign Intelligence Surveillance Act and weakened 15 privacy laws, raised requirements for the government to report secret eavesdropping to Congress and the courts. But Poindexter's assault on individual privacy rides roughshod over such oversight.

He is determined to break down the wall between commercial snooping and secret government intrusion. The disgraced admiral dismisses such necessary differentiation as bureaucratic "stovepiping." And he has been given a $200 million budget to create computer dossiers on 300 million Americans.

When George W. Bush was running for president, he stood foursquare in defense of each person's medical, financial and communications privacy. But Poindexter, whose contempt for the restraints of oversight drew the Reagan administration into its most serious blunder, is still operating on the presumption that on such a sweeping theft of privacy rights, the buck ends with him and not with the president.

This time, however, he has been seizing power in the open. In the past week John Markoff of The Times, followed by Robert O'Harrow of The Washington Post, have revealed the extent of Poindexter's operation, but editorialists have not grasped its undermining of the Freedom of Information Act.

Political awareness can overcome "Total Information Awareness," the combined force of commercial and government snooping. In a similar overreach, Attorney General Ashcroft tried his Terrorism Information and Prevention System (TIPS), but public outrage at the use of gossips and postal workers as snoops caused the House to shoot it down. The Senate should now do the same to this other exploitation of fear.

The Latin motto over Poindexter's new Pentagon office reads "Scientia Est Potentia" - "knowledge is power." Exactly: the government's infinite knowledge about you is its power over you. "We're just as concerned as the next person with protecting privacy," this brilliant mind blandly assured The Post. A jury found he spoke falsely before.

[Brief commentary: The Homeland Security Act is a seditious piece of political work that can cripple faith in government authority for its overreach and its contempt for the individual citizen. The ravaging of due process of those with autism in favor of a pharmacuetical company in the name of "domestic security" is but one node of many on this malignant political tumor. This is the stuff of dictators, despots and nanny governments, not Americans, and not conservative Republicans. Do we become Al Qaeda to catch Al Qaeda? –LS.]

Predecessor "A Particularly Lousy, Cynical Bill": Cure Autism Now Danish Study Changes CAN's position; The Homeland security bill apparently supported tacitly.

 

[The following commentary by CAN Co-founder Jon Shestack appeared in the August 5, 2002 edition of the SAR. Senator Frist's Bill was the predecessor to the legislation slipped into the Homeland security bill.]

Congress has recently been kind to the autism community and Senator Frist in particular was a prime supporter of the pediatric health act, which is why it is particularly disappointing to have the effort on S2503 led by a man who has always been a friend to our community. There are no two ways about it, from the autism community’s point of view, this is a particularly lousy, cynical bill, and Cure Autism Now does not support it.

Cure Autism Now has consistently had one and only one position on vaccines and autism (particularly the effects of Thimerosal). Our position is that there is not enough good scientific information on the subject and that is why we are funding work in this area.

S2503 is not about science and it is not really about universal vaccination. It is about tort reform. It is about providing total legal immunity for the vaccine community way before the facts are in. (It is as if Congress were saying, “You’re innocent even if proven guilty.”) The facts are not in. We don’t know yet if vaccines or Thimerosal have an important causal link to autism. We don’t know yet to what extent the CDC and FDA might have suspected a link but decided not to change policy or share the information with the public.

Given how little we know for certain, it seems very inappropriate for Congress to decide that the FDA, the CDC and the pharmaceutical industry should not be held accountable for any possible ill effects of vaccine policy, and in fact should get special protection over and above those already carved out in the Vaccine Injury Compensation act.

On the contrary, we believe that in America children and their families deserve special protection, not federal agencies or industry groups with the ability to spend 700 million dollars a year lobbying congress.

We do support safe childhood vaccinations. We do support continued scientific research. We also support full disclosure by the FDA and the CDC. We do support reform of the Vaccine Injury Compensation Act. We categorically do not support this bill, which comes to political conclusions without any foundation in scientific fact.

Today this bill is being marked up in the Senate Health, Education and Labor committee. We do not know if it will be voted down or sent on for full consideration by the Senate. We do know that in any event there is no further action to be taken until September when Congress is back in session. We also feel that it is exceedingly unlikely that Senator Daschle will allow this bill to come to the senate floor any time soon. We also believe that in the current climate where anything that smacks of cronyism is coming under extra scrutiny, even Republican and administration support for this bill will be tepid.

We believe that at this moment there is nothing critical to be done. If the bill gets out of committee unchanged Cure Autism Now will fight very hard against it -- both behind the scenes and on the front lines. If we have been laid back on this legislation, it is only because we felt that what we were seeing in the Senate was politics not policy and that the likelihood of S2053 becoming law was very slim. [Brief commentary: With the surely coincidental appearance of the Danish Report right at the closing days of congress when the vaccine suit capping legislation was snuck in the Homeland security bill, CAN has since announced, citing the controversial report, that now sufficient evidence is in to let vaccines off the hook with regards to having any connections to autism. This is probably why we so far have not seen CAN "fight very hard" against the current incarnation of the Frist Bill -- like issuing any action alerts to its members to contact their Senators to oppose it. But CAN is not alone in their tacit support for this legislation. Not one other national autism advocacy and research organizations, which are usually high profile on such national issues, has yet to issue action alerts to their members to contact their senators, either. Dear Senator Lott,

Please allot me a few moments of your time to tell you about my daughter Bailey. She is such a beautiful, bright and special little girl. She is also so very frustrated at not being able to do the things she used to do. Bailey is a victim of vaccine related autism. She could once eat everything she wanted to and played with her cousins at the playground. She walked around the farm and helped me feed the animals. She was speaking 14 words and putting two together. She used to call me Mama. I've not witnessed her open beauty in so very long. She keeps it all inside now, tucked away in a little box.

My daughter instead of going to the park everyday after school, goes to a Dr to get treatments for her allergies to nearly everything as well as treatments for her immune system. I've had to stop working because she is not well enough to be in school regularly. No employer will make provisions for a mother who comes and goes more then she comes. My husband, bless him, works day and night, unable to spend those special moments with his sweet "peanut" to make ends meat. So she can go to the Doctor, who is kind enough to lower the treatment costs.

My daughter is on a slow road to recovery and the road has it's bumps but she is getting there. I noticed symptoms right after Bailey got the first vaccine in the hospital Hepatitis B; she wouldn't nurse. Then she turned jaundice and it was said she had "breast-feeding" jaundice. I now know this wasn't breast-feeding jaundice.

It was because she was given a vaccine that wasn't necessary at too early an age when her liver wasn't even fully developed yet. Every vaccine thereafter would causes her to regress for a period of about a week or two. After that period she would come back again and was completely normal. I informed the Dr of her reactions. Her reply to me was I am a new mother and am being overly paranoid. My story is not the only story like this. Nearly all the mothers I've spoken to and there are hundreds of them have been through the same ordeal.

I was taught growing up that I should follow what happens in the government to offer my support on causes I have "researched". Yet, the government is not doing the same. The research done on the cases of all of these autistic children, which is now one in every 119, has been political. I don't understand, how I am to support a government that is supposed to protect us when I am seeing all of the underhandedness spilling out on to our children? One child in every 119. That many wouldn't get wiped out in a war. If this many children are affected, who will fight our wars in the future?

Our childrens futures are in your hands and every persons hands who this bill crosses. Can you feel its weight? Can you look down and see all the childrens faces filled with hope from the safety of their parents arms, all looking upon you to make a decision which will help their future. Nothing about this extra underhanded incentive will help warfare. Why are they taking this out on our kids?

As long-time readers of the Mercola.com newsletter know, it is only in the most important situations related to health that I ask you to take such direct and immediate action. Telling your Senators to vote NO to the Homeland Security Bill certainly qualifies as important, and here’s why: In the Homeland Security Bill (see Title III, section 304 (start at page 74) of HR 5710) http://hsc.house.gov/legislation/hr5710.pdf,

certain “pork” – provisions added by certain politicians with special interests, often without any public/media awareness at all – was inserted late in the bill’s life, and apparently without the knowledge of many members of the House of Representatives who already passed the bill on November 13.

One such piece of pork would give the Secretary of the HHS the authority to call for universal smallpox vaccination and other smallpox interventions with absolutely NO personal, NO religious and NO medical exemptions allowed! You’ll also find by reading Title III, section 304 of the bill that there are NO guarantees for humane quarantine laws.

Yet another sneaky insertion into this bill would allow the pharmaceutical manufacturer Eli Lily to go scot-free regarding any injuries and deaths caused by their thimerosal-based vaccines http://www.mercola.com/2002/mar/30/mercury_vaccine.htm. vaccines that contain mercury, in other words, and are likely at least partly responsible for the epidemic rise in autism, Alzheimer’s and other neurological disorders. Obviously a politician who thought this was a clever way to covertly pass his or her deal with a lobbyist added this rotten piece of pork; it has nothing to do with our nation’s security, except to cause us more harm.

The group PROVE (Parents Requesting Open Vaccine Education) was the first to inform me of this frightening pork in the Homeland Security Bill, and along with The Connecticut Vaccine Information Alliance (CTVIA), they have created a list of proposed amendments to HR 5710 that you can also forward to your Senators if you agree with these amendments.

If you do not agree with all of these amendments, you can forward those you do agree with to your Senators, or just contact your Senators and tell them NO to the current Homeland Security Bill because you: Value your right to refuse vaccinations based on religious, medical or personal reasons Do not want to allow the government to let Eli Lily off the hook for thimerosal-based vaccine-induced injuries and deaths Want to maintain certain rights and freedoms if you are put into quarantine by the government

The proposed PROVE and CTVIA amendments are as follows: H.R. 5710-Homeland

Security Act PROPOSED AMENDMENT 1: SEC. 304. CONDUCT OF CERTAIN PUBLIC HEALTH-RELATED ACTIVITIES.

Insert: (d) EXEMPTIONS FOR COUNTERMEASURES FOR CHEMICAL, BIOLOGICAL, RADIOLOGICAL, NUCLEAR AND OTHER EMERGING TERRORIST THREATS.

1. No citizen shall be forced to be vaccinated or receive medical treatments contrary to their own physician's or other health care provider's individual professional judgment.

2. No citizen shall be forced to be vaccinated or receive medical treatment contrary to their personal religious beliefs or practices.

3. No citizen shall be forced to be vaccinated or receive medical treatments that violate the judgment of the person's conscience.

4. Health care personnel shall not be forced to carry out orders contrary to the health care provider's conscientious beliefs.

5. A vaccine or medical treatment shall not be administered to any adult or child without the voluntary informed consent of the adult, the custodial parent or legal guardian of the minor child or ward, or the conservator of the individual to be vaccinated or medically treated.

(e) QUARANTINE OR ISOLATION IN RESPONSE TO CHEMICAL,BIOLOGICAL, RADIOLOGICAL, NUCLEAR AND OTHER EMERGING TERRORIST THREATS.

When a public health emergency has been declared relating to a communicable disease; 1. Citizens identified as being infected with the declared disease may be subjected to humane quarantine in order to prevent the spreading of disease.

2. Citizens identified as being exposed to the declared disease who claim a medical, religious, or conscientious exemption to vaccination or medical treatment may be subjected to humane quarantine for the duration of the incubation period of the disease in order to prevent the spreading of disease. Such citizens shall not be involuntarily quarantined with those who are infected or contagious.

3. Citizens claiming a medical, religious, or conscientious exemption who have not been identified as being exposed shall not be involuntarily quarantined.

4. Individuals or family members who regularly live together or where one person regularly provides essential support for another shall be permitted to stay together in either quarantine or isolation.

5. Custodial parents, legal guardians, or conservators of minor children, wards, or conservatees who may be quarantined or isolated shall be allowed to remain with their minor children, wards, or conservatees in quarantine or isolation.

6. Quarantine and isolation must be by the least restrictive means necessary to prevent the spread of a communicable disease to others and may include, but are not limited to, confinement to private homes.
