MODEL STATE EMERGENCY HEALTH POWERS ACT? BE AFRAID! BE VERY AFRAID! by Theodora Kerry

Though this bill was just stopped in the Assembly this is an issue I’m afraid won’t go away with one Assembly vote. So pay attention! Pay close attention!)

                In the aftermath of the September 11 attacks and the subsequent anthrax scare, Americans have been faced with difficult decisions about how to balance our need for security with our desire to live freely as guaranteed by our Constitution.  Unfortunately, most of these decisions are being made by the President and rubber-stamped by Congress, with little or no consultation with those of us who are most affected: the citizens!  Their assumption is that we, the people, will give-up anything, including our inalienable rights, in order to feel secure in our own communities.  They may have been right initially, but as the shock of 9/11 wears off, and the reality (and costs) of a never-ending war against terrorism sink in, many citizens are beginning to openly question the wisdom of blindly trusting our nation’s leaders to protect us.  After all, these are the same leaders who, despite having billions of our tax dollars at their disposal, were unable to protect us on 9/11, despite all the early warning signs that have been carefully documented by many long-term researchers, including Michael Ruppert, a former policeman, who has devoted over 20 years to studying the CIA.  His website, www.copvcia.com, will give you more than enough reason to question the official story about 9/11, and even more reason to openly challenge the next assault on our liberties which is coming down the pike: the Model State Emergency Health Powers Act (MSEHPA). Written by the Center for Law and the Public Health under the auspices of the Centers for Disease Control, this Act is already being considered in many state legislatures, including California where it was introduced in the Assembly in January as AB 1763.  Although the Act appears to be written in response to 9/11, it was already in the works well before then.

Major Provisions

                As written by the Federal authorities, MSEHPA would authorize the Governor to declare a state of public health emergency without consulting anyone and without any immediate accountability, even to the legislature until 30-60 days after the emergency is declared.  During that first month, the Governor would have the power to authorize public health officials to take the following actions with the full backing of the police and the National Guard.  These unelected officials would have the power to:

      • Mandate forced vaccinations, medical exams, and treatments without liability for any harm caused.  Neither personal medical conditions nor religious beliefs would be cause for exemption. Given that all of the vaccines being developed in response to potential bio-terrorist attacks are untested, we would be forced to be guinea pigs in direct contradiction to the Nuremberg Code created as a result of the medical atrocities committed by the Nazis in WWII.  That these vaccines will most likely be produced by DynPort Vaccine, whose Chairman, until recently, was H.P. Winokur, also a recent Chairman of the Enron Finance Committee, gives us even greater cause for alarm.

      • Quarantine people who have refused vaccinations or merely on suspicion of being exposed to a communicable disease. This act would allow for the imprisoning of large numbers of citizens in camps, with no protections for keeping families together or ensuring that people with existing medical conditions continue to receive their prescribed treatment.

      • Seize private property without compensation or recourse if it is deemed to be necessary to cope with the emergency.

      • Destroy private property without compensation or recourse if it is deemed contaminated.

      • Coerce medical personnel to work without compensation under threat of losing their license.

      • Suspend all laws and regulations which might get in the way!

                Just a few of the reasons to be very afraid of the Model State Emergency Health Powers Act / AB 1763. With legislation like this, who needs terrorists?

How Can We Stop MSEHPA?

                Despite little if any media attention on this bill, the word is spreading, and citizens are starting to speak out.  Coalitions of health organizations and political activists from left, right, and center are being formed across the country.  This has already had an impact in the Assembly’s Health Committee, which on April 16 rewrote the bill to authorize the creation of a Public Health Emergency Powers Commission.  This Commission would study legislation currently in place, compare it with MSEHPA, and take public testimony, with the intention of presenting a new, improved version to the Assembly within 6 months.  While this sounds like a step in the right direction, AB 1763 still makes it clear that the original MSEHPA is considered the standard to which our current law must measure up.  And did I mention all the federal money we’re being promised if we pass a version of MSEHPA that pleases the Empire?

                If ever there was a time to write your state and federal legislators, this is it!  They are under tremendous pressure to march lock step behind federal leaders who seem to thrive on crisis.  All the more reason to remind them that we, the voters, thrive on lawful  and democratic responses to these challenging times. I also encourage you to gather more information by visiting the websites listed below and to share what you learn with your friends, co-workers, and families.

                I often wonder how history would have been different if German citizens had actually voted on whether to send their Jewish neighbors to concentration camps, or if U.S. citizens had a choice about sending their Japanese-American neighbors to internment camps?  Well, it’s a new millennium, and we do have a choice. Use it or lose it!
