As Governor Pataki considers what he will have to do to rn for re-election next year, we want to demonstrate the depth of support for making effective, the patients choice to use alternative medical doctors. The pattern of unsubstantiated cases that have been brought against many of the alternative medical doctors practicing in the state have had a discouraging effect on many doctors who are intimidated from using the safer more effective natural theraoies we want available.

I have prepared a form letter below for you to send. Dear Governor Pataki:

I am very upset at behavior of the Office of Professional Medical Conduct (OPMC) in their actions against many of the leading holistic medical doctors in New York. Dr.Serafina Corsello of New York City, is recognized nationally for her holistic medical skill, she was named in 1992, a member of the first advisory committee to the Federal Office of Alternative Medicine, a part of the National Institute of Health.Dr. Rebecca Carley of Hicksville,Long Island has pioneered successful treatment of vaccine injured children. She successfully helps children injured by other doctors blindly following state mandated vaccination policies. Dr.Jennifer Daniels of Syracuse has brought the option of a more natural, non-toxic therapy to an under served minority population, even receiving your Woman of Distinction Award in 1998.

The disturbing common thread running through all these cases is the lack of a "complaint that is authentic and of sufficient substance to warrant investigation" as the NYS Court of Appeals required in Matter of Levin-Matter of McGrath,59 NY 2d 35,462 NYS 2d 838.

This is a blatant violation of the Alternative Medical Practice Act that we fought for and passed in 1994. The spirit and intent was to prevent these kinds of prosecutions. In these cases, where there are no legitimate patient complaints of harm, consumers are baffled why the prosecutions continue. There should be a responsibility of OPMC to fully explain why it is pressing these cases.Someone must exercise administrative oversight of this runaway agency.

This conduct is intimidating doctors starting out from exploring scientifically sound

treatments, this will eventually eliminate most patients’ability to find a doctor willing to use the safer, more natural treatment they want. This is a dangerous message to send to doctors who are justifiably impressed with the medical/scientific support for alternative treatments. Consumers will have no choice but to hold you responsible if your administration permits this unethical and illegal conduct of OPMC to continue. I look forward to your answer and corrective action taken.
