Shaking baby could become first-degree murder under bill

CHEYENNE, Wyo. (AP) - Shaking a baby to death could be first-degree murder under a bill expected to be considered by the Senate Judiciary Committee on Friday.

Sen. Kathryn Sessions, D-Cheyenne, said she introduced Senate File 71 Wednesday at the request of prosecutors, defense attorneys and employees of the Department of Family Services.

Sessions said the bill would give judges a tool to punish heinous cases and repeat offenders. First-degree murder is punishable by life in prison or death. Shaking a baby to death is currently considered manslaughter.

Sen. Cale Case, R-Lander, opposed the broad wording of the bill, saying he has a tough time believing that shaking babies is first-degree murder.

"This could apply to a woman who one time is stressed out. She loses her cool and does this terrible thing. Is that the same thing as the level of premeditation?" he said.

The bill would apply to anyone who fatally shakes or injures a child under 18. The perpetrator would have to be an adult at least four years older than the victim.
