POISON KILLED YURKO
'SHAKEN BABY'

A
pathologist has uncovered evidence that baby Alan Yurko, whose
father by the same name
is imprisoned in Florida for shaking him causing hemorrhage and death,
was instead killed by medical staff who massively overdosed the infant
with the drug
Heparin, only hours before he died. Heparin is a blood
anti-coagulant very similar to Warfarin --a poison which kills rats by
internal hemorrhaging.
Dr. Mohammed Al-Bayati, a
California-based expert toxicology witness, discovered in the course
of his 250 hour review of the medical records, that the dose of
Heparin was 8.8 times the level appropriate for the premature
infant's meager body weight. His just-issued
report concludes that Heparin caused severe subdural
bleeding in the brain and spinal cord and minor bleeding in one eye,
as well as other effects.
Heparin tops insulin and morphine as the leading drug
causing patient injury by improper dose in US hospitals, according
to the
MedMarx medication errors reporting system, says a 2001
study by U.S. Pharmacopoeia.
Recent Heparin-induced fatalities include
Jeffrey Owens, a gay man who died in June 2001 after being
administered a 100 times overdose of Heparin following a stabbing
outside a Riverside gay bar. The nurse had asked the doctor, a blood
bank worker and a hospital pharmacist for guidance. Neither knew the
correct dose, but the nurse medicated Mr. Owens anyway. He was rushed
to an operating room, but died hours later.
Difficulties
now face a successful prosecution of those charged by police with the
stabbing.
Also, in March 2002, Dr. Jonathan Reiner, cardiac specialist to
Vice-president Dick Cheney, was forced to make an out of court
settlement in a
lawsuit which claimed a Nebraska education administrator had died
from a ten times overdose of Heparin after he went to hospital with
chest pain.
CATALOGUE OF ERRORS
 In addition to Heparin
overdose, Dr. Al-Bayati's report also finds that baby Alan Yurko had
been overdosed with sodium bicarbonate prescribed to correct an acid
metabolism.
"Bicarbonate [...] should be stopped when the pH reaches 7.2 to
minimize possible detrimental side effects including cerebral edema,"
his report says.
But, according to Dr. Al-Bayati, the hospital records show a pH of
7.61 just before the infant died. He concludes the bleeding in the
brain and other tissues was caused by excessive treatment with heparin
and sodium bicarbonate.
This is confirmed, says Dr. Al-Bayati, by a scan of the brain that was
taken after admission and after five hours of Heparin overdosing. It
showed subdural hematoma only on the right side of the brain and none
on the left side. Yet, the autopsy found bleeding on the left side, so
this must have occurred after admission.
That contradicts the evidence at trial by Dr. Shashi Gore that
hemorrhaging was prior to admission and due to vigorous shaking of the
head.
VACCINE-INDUCED INJURIES
At eight weeks of age and despite multiple existing health problems,
Alan had been given six vaccines without any follow-up monitoring or
medical supervision. The Yurko campaign recently discovered that one
of the vaccines was from a batch that ranks number one in deaths, and
number one in non-recoveries, for Connaught Labs DTaP vaccines.
Thirteen days later the baby had a cardiac arrest, and apnea episode
and his father took him to Princeton hospital in Orlando, Florida. Dr.
Al-Bayati says a preterm baby is prone to exactly these serious
adverse reactions to vaccines, and by best practice should have been
monitored, says his report.
On admission to hospital, his doctor failed to realize that he was
diabetic as a result of infections induced by the vaccines, and was
suffering from meningitis, maintains Dr. Al-Bayati.
In diabetic children, cerebral edema is a common cause of death. Yet
his treatment only made this outcome more likely and also produced
bleeding in the brain and axonal injuries, which were portrayed at
trial as characteristic markers for Shaken Baby Syndrome(SBS). That
led to the false conviction of Mr. Yurko, he notes.
DUBIOUS MEDICAL EVIDENCE
Dr. Al-Bayati is very scathing of the medical evidence presented for
the prosecution at Alan Yurko's trial. One of the physicians giving
evidence had spent only 40 minutes in examination of the infant and
review of the medical data. Furthermore, instead of direct evidence of
SBS, the court was offered merely theory, he says.
Astonishingly, none of the prosecution medical witnesses had examined
the mother's pregnancy charts or the infant's serious medical problems
subsequent to preterm birth. Yet, their testimony was that the baby
was healthy prior to his hospital admission.
In particular, Dr. Al-Bayati details 23 instances where trial
testimony by Dr. Shashi Gore's was at variance, he says, with the
medical evidence.
 "I believe that the cases of
individuals who were convicted of killing babies by SBS based on the
axonal injuries, subdural bleeding, and eye bleeding should be
reexamined," says Dr. Al-Bayati.
"The state of Florida has the responsibility to review the evidence
presented in this report concerning the Yurko’s case. It shows that
Mr. Yurko is innocent and they should take a speedy action to free him
from prison," he recommends in conclusion.
PENDING APPEAL
Currently imprisoned for life without parole, Mr. Yurko filed a
motion for
post conviction relief before The Ninth Judicial Circuit Court in
Orlando, Florida on March 22nd, 2002. He hopes for a ruling by
mid-2003 granting an evidentiary hearing which would allow him present
expert testimony. A previous appeal before The Fifth District Court on
March 7, 2000 failed to overturn his conviction.
But, if a new evidentiary hearing were granted, Dr. Al-Bayati's
report and discovery of the 'smoking-gun' Heparin overdose
would cast a substantial reasonable doubt on the conviction and could
lead to civil or criminal proceedings against others.
