Senate Bill 2053 would dump vaccine-damaged kids out of the protections and remedies of the civil court. It would prevent parents from suing the drug companies for the harm--Including Autism--caused by poorly manufactured and poorly tested vaccines.

Juries, who are not beholden to corporate campaign finance obligations should decide whether the families are entitled to compensation from the drug companies. It should not be decided by politicians who are.

LETTERS FROM TWO PARENTS

To their Senators

Dear Senator Kennedy:

Our son, who is now 4 years old, was diagnosed with severe autism at 2 1/2 years old. He is vaccine damaged. He has documented mercury poisoning. He is under the care of 2 doctors.

We are now trying to remove mercury from his body and brain. The costs to date for his educational, behavioral, and medical rehabilitation have been staggering to a middle class family. But money is not even the most tragic part of the picture. The devastation that has been wrought upon children with vaccine-injury induced severe autism and their families is hard for someone who is not involved to imagine.

They face an incalculably decreased quality of life during childhood - a virtual loss of childhood; and they face such other health problems as kidney and intestinal damage and impaired immune systems.

Ironically, the very vaccines that we gave our son in hopes of protecting him have now been prohibited for him for the rest of his life, as they could even pose a threat to his very life.

These children must not also lose the legal right for their day in court to address the catastrophic consequences to their lives delivered by vaccines and vaccine manufacturers.

We are asking you, Senator Kennedy, to refuse SB 2053, the Frist Bill. Please help preserve the right to justice for these children who have already had so many basic human rights stolen from them by their disabilities.

Dear Senator Frist,

I always vote Republican, but Senate Bill 2053, which I understand to be authored by you, is giving the Party a serious black eye.

I have an autistic son, now 17 years old. As explained on my website, http://kidsbright.org , there is reason to believe that mercury poisoning from Thimerosal in his childhood vaccinations contributed to his severe developmental problems. Recent tests show he still has a mercury level in his body that is 10-times the reference range.

More than 500,000 Americans share my son's diagnosis. There is no longer any serious debate over whether the rate of autism is increasing; it definitely is. Something is causing that increase. The problem is complex, but vaccine policy in general and mercury poisoning in particular are likely factors. Yet there are self- serving forces in this country that would have us believe that this is just something that happens, or is an unavoidable genetic problem.

Senator, every citizen of this country has the right to pursue justice when wronged. I am asking you to recall SB2053. It is anti-child, pro- corporation, and anti-justice. Families that choose to pursue the issue of vaccine damage in court most certainly have the right to do so. You, Sir, have no right to block that avenue to them.

I implore you, Senator, as a Republican and a protector of our nation, to put your priorities in the right place and stop this infamous bill from going forward.
